2. The petitioner has prayed for bail in connection with NDPS Case No.92 of 2025 arising out of Sakra P.S. Case No. 149 of 2023 registered for the offence punishable under Sections 8 & 20(b)(ii)(B) of NDPS Act and under Sections 25(1-B)a, 26 & 35 of the Arms Act.

3. The case of the prosecution, in short, is that from the possession of co-accused Nitesh Kumar, country made pistol and 8.5 kg of ganja was recovered.

4. Learned counsel appearing on behalf of the petitioner has submitted that co-accused Nitesh has named this petitioner as the person who fled away. Learned counsel for the petitioner has further submitted that the petitioner is innocent and has committed no offence. The petitioner was not apprehended rather his name has surfaced in the statement of co-accused Nitesh Kumar. Learned counsel for the petitioner has submitted that the petitioner is languishing in judicial

5. The application for bail is opposed by learned APP for the State. Learned APP has further submitted that the petitioner is having criminal antecedent of 18 cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the condition that :- (i) the petitioner shall co-operate in the trial; (ii) the petitioner shall remain physically present on each and every date, whenever required;

(iii) the petitioner shall mark his weekly attendance at Sarairanjan P.S.

7. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Exclusive Special Judge-II (NDPS), Muzaffarpur in connection with NDPS Case No. 92 of 2025 arising out of Sakra P.S.
