JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B, 201 and 120B of the Indian Penal Code.

The accusation is of killing the daughter of the informant after one year of the marriage for non-fulfilment of the dowry demand and disposing of the dead body.

It is submitted by learned counsel for the petitioner that the victim died due to illness and the petitioner was not present at the place of occurrence as he was at Samastipur in connection with business at the relevant time and the family members of the victim participated in the cremation.

Patna High Court Cr.Misc. No.23584 of 2015 (2) dt.07-07-2015 2/2 Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Mahua P.S. Case No. 221 of 2014 pending in the court of learned CJM, Vaishali at Hajipur. Accordingly, the application is disposed of.
