JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Mokama PS case no. 214 of 2017 instituted for the offences punishable under Sections 20, 22 of N.D.P.S. Act. The allegation is regarding recovery of 260 gms. of ganja from the pocket of the trouser of the petitioner. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in the cases, which are pending against the petitioner, he is on bail. It is further submitted that the petitioner is languishing in custody since 27.01.2018 and the quantity of ganja recovered does not fall within the category of commercial quantity as per the schedule to the N.D.P.S. Act.
