JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Petitioner was apprehended with a motorcycle. He, on interrogation had disclosed to be stolen one, purchased from Mumtaz. As directed by the informant he dialed Mumtaz with a direction to come at particular place where, he was apprehended by the informant as well as from his possession one Glamour motorcycle was seized to be stolen one. He had further confessed that kingpin happens to be Rabindra Sahni. Then thereafter, house of Rabindra Sahni was raided where from a motorcycle has been seized.
It has been submitted on behalf of petitioner that he was not knowing since before that the motorcycle which he has purchased happens to be stolen one. Apart from this, as directed by the police he dialed and presence of Mumtaz is indicative of the fact that petitioner has got bonafide conduct. Furthermore, petitioner has got no criminal antecedent and is under custody since 17.07.2017.
Learned Additional Public Prosecutor opposed the prayer.
Patna High Court Cr.Misc. No.48208 of 2017 (2) dt.17-10-2017 In the aforesaid facts and circumstances of the case, petitioner Deepak Kumar is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned ACJM, XIIIth, Motihari, East Champaran in connection with Chakiya P.S.
