JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-07-2018 The petitioners, who are the mother-in-law and brother-in-law of the deceased, have sought bail in anticipation of their arrest in connection with Bhagwanpur P.S. Case No. 285 of 2015, dated 27.12.2015, instituted for the offences under Sections 304(B) and 201 of the Indian Penal Code.
Though the allegation against the petitioners is of having killed the deceased because of non-fulfillment of dowry demands, but the investigation reports reveal that the
Patna High Court Cr.Misc. No.31351 of 2018 (4) dt.19-07-2018 2/2 deceased as well as her sister-in-law fought amongst themselves and both of them consumed poison.
Unfortunately, only the deceased died, but the sister-in-law of the deceased survived. An effort was made by the family members to provide medical treatment to the deceased, but to no avail. The aforesaid fact was brought to the notice of the informant and only, thereafter, the dead-body was cremated.
It appears, it has been argued, that because of the snapping of the family ties with the death of the deceased, the present case has been lodged.
Considering the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 3rd Additional Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 285 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
