The petitioner seeks bail in connection with Kuchaikot P.S. Case no. 170 of 2017 registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code. On a tip off, police apprehended the petitioner and one Imran Alam along with stolen motorcycle and on the basis of confessional statement of Imran Alam, two others stolen motorcycles were recovered and seized.
It is submitted by the learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner rather jointly from the possession of the petitioner and Imran Alam.

No.46004 of 2017 (2) dt.20-09-2017 2/2 Virtually, the said motorcycle was in possession of the Imaran Alam and the petitioner had no knowledge of his complicity in the occurrence of stealing the motorcycles and he had simply accompanied him on the call given by Imran Alam and in the meantime, he was arrested along with him. The petitioner has been languishing in custody since 26.08.2017. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. The prayer is rejected.
However, the petitioner may renew his prayer for bail after framing the charge.
