JUSTICE SANJAY PRIYA ORAL ORDER 3/ 05-03-2018 This application has been filed for quashing the order dated 17.01.2015 passed by the 1st Additional Sessions Judge, Motihari, in Sessions Trial No.697 of 2013 arising out of Turkaulia (Banjaria) P.S. Case No.172 of 2013, by which petition filed on behalf of the petitioner under Section 227 Cr. P.C. was rejected.

A report was called for from the Court below, which has been received.

It has been submitted in the report that Charge has already been framed in this case on 25.03.2015 and out of nine charge-sheeted witnesses two witnesses have already been examined.

In view of such, this Court is not inclined to interfere

Patna High Court Cr.Misc. No.8606 of 2015 (3) dt.05-03-2018 2/2 with the impugned order.

This application is, accordingly, dismissed.

The court below will proceed with the trial in accordance with law.
