2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 341 , 323 , 307 and 379 of the Indian Penal Code .

3. As per FIR, on the alleged date and time occurrence , all the accused persons including these petitioners assaulted the informant and his father and also snatched Rs. 5000/- , golden chain and mobile phone .

4. It is submitted on behalf of the petitioners that these petitioners and informant are co-villagers and due to pending land dispute , an altercation took place between both the parties.

Patna High Court CR. MISC. No.20071 of 2024(2) dt.02-04-2024 2/2 Allegation of assault is general and omnibus. Rest of the allegation is super addition to make the case grave . Petitioners claim clean antecedent.

5. Learned counsel for the State oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - 1st Gaya in connection with Wazirganj P.S. Case No. 267 of 2013 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
