JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is apprehending his arrest in connection with Palasi PS case No. 238/2014 for the offence under section 406, 409, 420, 466, 468, 471 and 120(B) of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the petitioner, being Mukhiya of Gram Panchayat Raj, Baradbatta, P.S. Palasi district Araria defalcated a sum of Rs. 3,65,874/- for the scheme No. 01/13-14 by committing irregularities and illegalities and issued cheques for the aforesaid amount to the distributors and suppliers.

It is submitted on behalf of the petitioner that he is Mukhiya of the said Gram Panchayat and it is alleged that he has misappropriated the government money to the tune of Rs.

Patna High Court Cr.Misc. No.23627 of 2015 (2) dt.06-07-2015 2/2 3, 65,874/-. It has further been submitted that the petitioner has got no criminal antecedent and he is ready to deposit a sum of Rs. 50,000/- in the court below which shall be subject to final disposal of the case.

On behalf of the State, it has been submitted that petitioner is named in the FIR.

Considering the aforesaid facts, it is directed that petitioner shall deposit a sum of Rs. 50,000/- in the court below which shall be subject to final disposal of the case. With the said condition, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Palasi PS case No. 238 of 2014, subject to condition as laid down under section 438(2) of the Cr. P.C.
