JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections, 147, 149, 341, 323, 325, 307, 504, 506 of the Indian Penal Code and under Section 3(1) (x) (v) SC/ ST Act.
The prosecution case is that on 19.11.2015 at 6 PM the informant was sitting at Akhoura bus stand with Kanhaiya Ram. In the meanwhile, some altercation took place between Kanhaiya
Patna High Court Cr.Misc. No.18449 of 2016 (2) dt.29-04-2016 2/2 Ram and Dablu Singh. On protest being made, Dablu Singh called others thorough phone, they came and abused and assaulted the informant. It is further alleged that on 22. 11.2015 the accused persons also abused the informant.
It is submitted by the learned counsel for the petitioners that injuries of the informant have been found to be simple in nature and the informant has retracted from his earlier version and filed a petition to that effect before the court below. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Chainpur P.S. case No. 224 of 2015 pending in the court of learned ACJM, Bhabua, Kaimur. This application is disposed of with the aforesaid observation/direction.
