ANJANA MISHRA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Turkaulia P.S. Case No.9 of 2016 for allegedly having committed the offence under Sections 272, 273 of the Indian Penal Code and Section 47A of the Bihar Excise Act. Learned counsel for the petitioner submits that the recovery of liquor was not from the conscious possession of the petitioner, rather it was from near the canal adjacent to the house of the petitioner and, therefore, the petitioner may not be prosecuted in connection with the present case. Considering the aforementioned facts and circumstances and that the petitioner has no similar antecedent,
