JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

It is a case of recovery of stolen motorcycles from the accused persons including the petitioner. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. It is further submitted that the vehicle which was driven by the petitioner is registered in the name of the petitioner. The petitioner had produced relevant papers regarding ownership of the

No.15914 of 2023(2) dt.29-04-2023 2/2 motorcycle but the police did not accept the document and demanded bribe and when the petitioner failed to fulfill their demand, he was arrested. The petitioner is languishing in custody since 14.12.2022. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 801 of 2022.
