Petitioner seeks bail in connection with Excise Case No. 2204/2017, arising out of Barhara P.S. Case No. 191/2017 for offences punishable under Section 30(A) of the Bihar prohibition and Excise Act, 2016.
The prosecution case, as lodged by the police personnel, is that on raid they apprehended two persons who were coming on a motorcycle, who fell down and were caught. From the possession of the petitioner 45 litres of foreign liquor was recovered in a bag. Accordingly, a seizure-list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has

He submits that nothing has been recovered from his conscious possession and he is languishing in judicial custody since 28.06.2017. It is further submitted that Section 100 of the Cr.P.C. has not been complied with.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th ADJ, Ara, Bhojpur, in connection with Excise Case No. 2204/2017, arising out of Barhara P.S.
