====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-04-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 303(2), 317(2), 317(4), 112 of the Bharatiya Nyaya Sanhita.

3. According to F.I.R., on the alleged date and time of occurrence, two persons started fleeing away after seeing the police party and co-accused Sk. Iqbal was apprehended on the spot who disclosed the name of this petitioner. On search, several electrical items were recovered from his possession.

4. Learned counsel for the petitioner submits that no incriminating or stolen material has been recovered from conscious possession of the petitioner and he is no way

Patna High Court CR. MISC. No.17740 of 2025(2) dt.09-04-2025 2/2 connected with the aforesaid recovery. Petitioner has been made accused in this case merely on the basis of confessional statement of co-accused. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Katihar in connection with Dandkhora P. S. Case No. 79 of 2024, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
