The petitioner apprehends his arrest in Isuapur P.S. Case No. 80 of 2015, registered for the offences punishable under Section 304 of the Indian Penal Code.
It is submitted that while the petitioner was connecting electric wire in generator, the petitioner started the generator and the deceased got electrocuted and died. It is further submitted that the case has been compromised and the informant himself stated that the deceased died due to electrocution.
It appears that the anticipatory bail of the petitioner was earlier rejected on 30.11.2015 passed in Cr. Misc. No. 40758 of 2015. I do not find any fresh ground to consider the prayer for anticipatory bail of the petitioner.
Patna High Court Cr.Misc. No.18163 of 2016 (2) dt.31-08-2016 2/2 Accordingly, the prayer for anticipatory bail of the petitioner above named in Isuapur P.S. Case No. 80 of 2015, is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, his prayer shall be considered on its own merit without being prejudiced by this order and considering the fact that the case has been compromised.
