SONI SHRIVASTAVA ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 29-06-2026 The appellants herein impugn the order of the learned Single Judge in C.W.J.C. No.8084 of 2023.

Learned counsel for the appellants submits that the relief ought not to have been granted to the respondents as detailed in the said Order as the said issue already stands decided and answered by a Division Bench of this Court vide order dated 27th September, 2016 in L.P.A. No.1699 of 2013 (Kranti Kanak and others Vs. The State of

Per contra, it is submitted by learned counsel for the respondents that the learned Single Judge has specifically recorded that, the State does not dispute the submissions made on behalf of the petitioners (respondents herein). In such circumstances, the appellant has, in fact, no ground to file the instant L.P.A., having conceded to the case of the respondents and the consequent reliefs that followed on the matter not having been disputed by the State appellants.

4. We have heard learned counsel for the parties at length and perused all pleadings and document on record as also the impugned judgment.

5. We have given our due consideration to the submissions made on behalf of the parties. The impugned order is reproduced here-under:

"Heard learned counsel for the petitioners and learned counsel for the respondents/State.

2. This writ application has been filed for issuance of appropriate writ(s)/direction(s) for commanding the respondents to grant matric trained scale from the date of completion of three years of service w.e.f.

the date of appointment along with all other consequential benefits.

3. Learned counsel for the petitioners submits that as per terms & conditions of appointment, all these petitioners should have been sent for in-service teacher training within two years by the respondent authorities, but despite several representations to the respondent authorities, these petitioners were not sent for such training. In such situation, on the

4/5 laches of respondent authorities, the petitioners cannot be made to suffer. In this regard, learned counsel for the petitioners has placed reliance on Annexure - 4 i.e. order of the Single Bench dated 11.04.2018 passed in C.W.J.C. No.

7322 of 2017 (Abdus Samad v. The State of Bihar & Ors.) and the said order has already been affirmed by the Division Bench, vide order dated 08.07.2022 passed in L.P.A. No. 502 of 2021 (Annexure - 5). Accordingly, learned counsel for the petitioners prays for considering the case of petitioners in the light of aforesaid orders.

4. Learned counsel for the State does not dispute the submission made on behalf of the petitioners.

Considering the submission made on behalf of the parties and materials available on record, the writ petition stands disposed of with a direction to the concerned respondent(s) to consider the case of the petitioners for grant of matric trained scale on completion of 3 years from the date of joining of the petitioners, as they cannot be made to suffer on account of lapse of the respondents in non-sending petitioners for in service training. Necessary decision in this regard may be taken by the respondents within a period of sixty days from the date of receipt/production of copy of this order and consequential benefit should be extended to the petitioners within a further period of one month from the date of such decision.

6. With above observation and direction, the writ petition is disposed of."

6. Thus, it is apparent from a bare perusal of the impugned order that, the Court has elucidated the case of the respondents in paragraph-3 of the impugned order. In paragraph-4 of the impugned order, the counsel for the respondents (appellants herein) has with clarity submitted

5/5 that, the State does not dispute the submissions made on behalf of the petitioners. It is subsequent to such submission that the learned Single Judge has recorded the conclusion in paragraph-5 of the impugned order, granting the reliefs prayed for by the petitioners in the said writ petition.

7. In light of the foregoing facts and circumstances, we are constrained to observe that the appellants have no ground for filing the instant L.P.A., having once submitted that, they have no dispute to the submissions of the respondents and thereby conceded to the case of the respondents.

8. Consequently, we are inclined to and do uphold the impugned order and dispose of this L.P.A. accordingly.
