.... .... Opposite Party ====================================================== Appearance :

For the Petitioner/s : Mr. Sharda Nand Mishra For the Opposite Party/s : Mr. Sri Murlidhar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 3.

11-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application has been filed for the grant of regular bail to the petitioner in connection with Turkauliya P.S. Case No. 321/2016, S.T. No. 06/2017 for the offences punishable under Sections 364/34, 302, 201, 120(B) of the Indian Penal Code pending in the court of learned 8th Additional Sessions Judge, East Champaran, Motihari. Perused the report kept at Flag-'A' and heard learned counsel for the petitioner as also learned Additional Public Prosecutor for the State.

It appears that out of 16 witnesses, 10 witnesses have already been examined in this case and now only 6 remaining witnesses are to be examined.

Patna High Court Cr.Misc. No.31999 of 2018 (3) dt.11-07-2018 Considering the nature of allegations and the fact that earlier prayer for bail of this petitioner was rejected by this court and considering the seriousness of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer for regular bail of the petitioner is rejected.

The trial court is directed to conclude the trial as early as possible and in course of trial the Public Prosecutor as well as the Superintendent of Police, East Champaran (Motihari) are expected to cooperate by producing all the witnesses particularly the official witnesses on the date fixed by the trial court. It is expected that all the prosecution witnesses are produced and examined within a period of six months.
