====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 24-04-2019 The father of the petitioner, who served as Assistant-Cum-Accountant with respondent No. 2/the
2/4 Samastipur District Central Co-operative Bank Ltd., died in harness on 12th of June, 2014. The petitioner made an application before the concerned Authority for being appointed on compassionate ground, so that the family gets monetary support.
2. The claim of the petitioner was forwarded and necessary documents were asked for from the petitioner.

In the meantime, it has been submitted, the petitioner had, in order to maintain his family, started working on a contract basis as a Collection agent and on the assurance of the respondents that very soon a decision shall be taken on the issue of appointment of the petitioner on compassionate ground, the petitioner had resigned from even such temporary engagement as a Collection agent with a private Company.
4. The petitioner, therefore, has legitimate expectation that a decision with respect to consideration for appointment on compassionate ground would be taken at the earliest, which has yet not been done.
5. A prayer, therefore, has been made for
3/4 directing the concerned respondents to finalize the decision making process regarding compassionate appointment of the petitioner in place of his father (deceased) on any Class-III post.
6. Under the aforesaid circumstances, this Court directs the petitioner to make a fresh representation before the Managing Director of Samastipur District Central Co-operative Bank Ltd. (respondent No. 3), detailing his grievances, within a period of two weeks from today, who, on receipt of such representation, shall dispose it off by a reasoned order in accordance with law, within a further period of four weeks thereafter. In case, the claim of the petitioner was forwarded by the concerned Authorities, it is expected that a decision in that regard shall be taken with urgent despatch, keeping in mind that only for bailing out a family from financial distress with the snapping of the monetary source, such compassionate appointments are given. The death of the employee has taken place on 12th of June, 2014 and till date, no decision has been taken, necessitating the petitioner to approach this Court.

7. With the aforesaid observation/direction, the writ petition stands disposed off.
