Having regard to the fact that the petitioner is aggrieved by an order of punishment removing him from service in a departmental proceeding and that such order is appealable before the appellate authority in terms of Rules and Regulations of the Central Bank Bank of

Patna High Court CWJC No.7900 of 2015 (2) dt.19-05-2015 India, this writ application definitely is premature, inasmuch as, any order of punishment in a departmental proceeding can only be said to be concluded after its affirmance or otherwise in the appeal.

When such an observation has been made, learned counsel for the petitioner seeks permission to withdraw this application in order to enable the petitioner to file an appeal before the appellate authority.

This application is, accordingly, permitted to be withdrawn with the aforementioned liberty.
