The petitioners seek bail in a case registered for the offence punishable under Sections 341, 323, 308, 379, 504 & 506/34 of the Indian Penal Code.

While the informant along with her husband and dewar was at her house petitioners along with two other accused persons armed with deadly weapons are said to have reached at their hosue and started abusing them. One co-accused person assaulted her husband on his head by means of sword and he fell down. Co-accused Munshi Singh snatched her golden chain

Patna High Court CR. MISC. No.13936 of 2020(4) dt.22-06-2020 2/2 amounting to Rs.45000/- and petitioner no.2 snatched her golden earring.

It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. They have been falsely implicated in the case due to dirty village politics. There is a case and counter case between the parties. Petitioners and other side are gotias and there was a free fight between them and both sides sustained injuries. Petitioners' side sustained grievous injury. It is also submitted that altogether six injuries have been found on the body of the victim but all are simple in nature. Petitioners have no criminal antecedent and are languishing in custody since 22.12.2019.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No.314 of 2019.
