JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This modification petition has been filed for extension of time to surrender in Complaint Case No. 1657 of 2013 in the light of order dated 02.04.2015 passed in Cr. Misc. No. 12462 of 2015.
It is submitted that vide order dated 02.04.2015 passed in Cr. Misc. No. 12462 of 2015 petitioner was granted provisional bail for the period of four months but the petitioner could not surrender before the court of Sub Divisional Judicial Magistrate, Purnea in time and, therefore, time for surrender of the petitioner should be extended.
Patna High Court Cr.Misc. No.22996 of 2015 (3) dt.22-05-2015 In view of the aforesaid submissions, petitioner is directed to surrender before the court of Sub Divisional Judicial Magistrate, Purnea in Complaint Case No. 1657 of 2013 within six weeks from today and accordingly, the time for surrender of the petitioner in the light of order dated 02.04.2015 passed in Cr. Misc. No. 12462 of 2015 is extended in the manner as stated above.
Accordingly, this modification petition stands disposed of.
