JUSTICE PURNENDU SINGH ORAL ORDER 15-07-2026 Heard Mr. Ashutosh Tripathy, learned counsel appearing on behalf of the petitioners; Mr. Jyoti Prasad, learned counsel for the informant and Mr. Amitesh Kumar, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Barhari P.S. Case No. 03 of 2025, registered for the offence punishable under Section 303(2) of the BNS.
3. Learned counsels appearing on behalf of the respective parties inform this Court that a joint compromise petition has been filed before the learned District Court and, as such, to give rest to the ongoing prosecution against the
Patna High Court CR. MISC. No.17905 of 2026(4) dt.15-07-2026 2/2 petitioners, they don't want to proceed with the case pending before the learned District Court.
4. Learned District Court, in such circumstances, is directed to verify, as to whether, any joint compromise petition has been filed before the concerned District Court where the case is pending. If it is found that such a joint compromise petition has been filed, the learned District Court shall release the petitioners on pre-arrest bail in view of the law laid down by the Hon'ble Supreme Court in the case of Naushey Ali & Ors. Vs. State of Uttar Pradesh & Anr. reported in (2025) 4 SCC 78, in accordance with law.
5. Accordingly, the present application stands disposed of.
