The petitioners apprehend their arrest in Dumra P.S. Case No. 423 of 2021, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

As per the complaint case, petitioners assaulted the father of informant by means of rod and danda and petitioner no. 2 outraged the modesty of Asgari Khatoon. It is submitted that complaint petition has been filed after lapse of three months of the occurrence and there is no explanation for the same. Present case is counter blast of Dumra

Patna High Court CR. MISC. No.17330 of 2022(2) dt.29-08-2022 2/2 PS Case No. 173 of 2021 filed by petitioner no. 1 against the informant and others.

Counsel for informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 423 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
