JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending his arrest in connection with Banka P.S. Case No. 411 of 2008 and G.R. No. 1389/2008 registered for the offences punishable under Sections 467, 468, 471, 409, 420 read with 120-B of the Indian Penal Code, seeks the privilege of pre-arrest bail.

At the very outset, it has been submitted that the petitioner was not initially tried and he has been summoned under Section 319 Cr.P.C. resulting he is apprehending his detention. As the petitioner has been summoned under Section 319 Cr.P.C. during trial and as such, he is directed to surrender in the court

Patna High Court Cr.Misc. No.29723 of 2014 (2) dt.14-01-2015 below and seek regular bail and in that event, he shall be released on bail on execution of bail bond to the satisfaction of the court concerned.

Accordingly, the prayer of pre-arrest bail of the petitioner is disposed of.
