The petitioner seeks bail in Rajauli P.S. Case No. 208 of 2016, instituted for the offence under Section(s) 47(a) and 57 of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner. He is not named in the written report.
It is alleged in the written report that informant during patrolling duty saw one Innova car and one Honda city coming from Jharkhand. On seeing the police party said Innova car tried to escape but after chasing, the said car was apprehended. It is further alleged that one person namely, Navlesh Kumar was apprehended by the informant and another managed to run away. The apprehended accused Navlesh
Patna High Court CR. MISC. No.20176 of 2019(2) dt.02-04-2019 2/2 Kumar disclosed the name of petitioner as owner of the Honda City car and driver as Mahesh Yadav. On search of both the vehicles foreign liquor has been recovered.
Petitioner is in custody since 6.12.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II cum Spl. Judge, Excise Court, Nawada, in connection with Rajauli P.S. Case No. 208 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. It is mentioned in paragraph-3 of the bail petition that two Excise cases are pending against the petitioner. Petitioner will file affidavit at the time of furnishing bail bonds that he will not indulge in such type of activity in future, failing which, the bail bonds of the petitioner in the instant case will liable to be cancelled.
