The petitioner is apprehending his arrest in connection with Barachatti P.S. Case No. 822/17 (GR No. 2682/17), registered for offences punishable under Section 30(a)/38/47 of the Excise Act, 2016.
Allegation is of recovery of two quintal unprepared Mahua kept in 20 plastic jar and 30 litre prepared Mahua wine kept in yellow colored plastic jar.
It has been submitted on behalf of the petitioner that the recovery has been made from different houses and he has falsely been made accused in this case and nothing has been recovered from his conscious possession and the house from which the
Patna High Court Cr.Misc. No.30513 of 2018 (2) dt.04-06-2018 2/2 recovery was made was a vacant house. Further the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Jude (Excise), Gaya in connection with Barachatti P.S. Case No. 822/17 (GR No. 2682/17, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) sunil/- U T
