JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-06-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner seeks bail in connection with Dehri (Indirapuri O.P.) P.S. Case No. 733/2019 registered for the offences punishable under Sections 147, 148, 149, 302, 307, 504 of the Indian Penal Code and 27 of the Arms Act. Petitioner is in jail custody since 13.12.2019. No doubt, the petitioner is named in the first information report with allegation that he made firing but according to the prosecution case itself, the firing of petitioner did not hit to anybody.

Learned counsel of the petitioner submits that coaccused Raj Kumar Singh, against whom there is allegation of instigation to other accused, has already been granted privilege

Considering the aforesaid facts and circumstances as well as submissions of the parties as well as this aspect of the matter that the petitioner does not have any criminal antecedents and the investigation against him has already been completed, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri (Rohtas)/concerned court in connection with Dehri (Indirapuri O.P.) P.S. Case No. 733/2019.
