JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-09-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Parbatta (Maraiya) P.S. Case No. 11 of 2017 registered under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

As per the prosecution case, the petitioner along with other accused persons resorted firing to establish his supremacy in the village. The petitioner was apprehended with one loaded pistol and two live cartridges.

It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the possession of the petitioner. The allegation levelled against the petitioner is general and omnibus in nature. He has been languishing in custody since 11.01.2017. Earlier bail petition of

Patna High Court Cr.Misc. No.44941 of 2017 (2) dt.13-09-2017 2/2 the petitioner was rejected with liberty to renew the same after framing of charge and now the charge has been framed against the petitioner on 17.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 11 of 2017.
