This is an application for bail in connection with Kothi P.S. Case No. 38 of 2016, corresponding to Sessions Trial No. 18 of 2017/85 of 2017, registered for the offences punishable under Sections 302/34, 120B of the Indian Penal Code and 27 of the Arms Act.
Allegation as per FIR is of murder of Officer-in-Charge of Kothi Police Station and petitioner is named in the FIR. Submission of learned counsel for the petitioner is that except suspicion there is nothing against him and co-accused persons have been granted bail by different co-ordinate Benches of this Court and petitioner is in custody since 28.10.2016. Heard learned APP also, who has opposed the prayer for
Patna High Court Cr.Misc. No.41185 of 2017 (4) dt.16-10-2017 2/2 bail stating that witnesses have seen the petitioner at the place of occurrence.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. Hence prayer for bail is rejected. (Vinod Kumar Sinha, J) spal/- U
