JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bhagwanpur Hat P.S. Case No. 30 of 2018 for the offences under Sections 272, 273, 308, 420 of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner was apprehended in connection with seizure of 667 litres wine. He further submits that in the instant case other coaccused, namely, Jitendra Rai & another have been granted bail vide order dated 11.04.2018 in Cr. Misc. No.19989 of 2018, Dhananjay Kumar Sah @ Dhananjay Sah has been granted bail vide order dated 02.05.2018 in Cr. Misc No. 26655 of 2018 and Satrughan Yadav has been granted bail vide order dated

Patna High Court Cr.Misc. No.32544 of 2018 (2) dt.06-06-2018 2/2 11.05.2018 in Cr. Misc. No. 28744 of 2018.

Considering the fact that other similarly circumstanced co-accused have been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Bhagwanpur Hat P.S.
