Petitioner is seeking anticipatory bail in connection with Simra P.S. Case No. 3 of 2019 registered for the offences punishable under Sections 308, 379, 341, 323 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the specific allegation of assault is against one Rohit Paswan. It is alleged that this petitioner has taken away Rs.20,000/- from the pocket of the informant and has also indulged in beating him, but there is no specific allegation of assault against this petitioner. It is submitted that the allegations are general and omnibus and now the matter has also been settled between the parties.

Patna High Court CR. MISC. No.15356 of 2019(2) dt.14-03-2019 2/2 Learned APP for the State is present and has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein the submission is that there is no specific allegation of assault against the petitioner and that the petitioner has no criminal antecedent as also that the matter has been settled between the parties amicably, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned Judicial Magistrate-1st Class, Aurangabad in connection with Simra P.S. Case No. 3 of 2019, subject to the condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) arvind/- U T
