The petitioner seeks regular bail in connection with Tiar P.S. Case No.03 of 2018 registered for the offences punishable under Sections 341, 323, 354(A)(B), 504 and 34 of the Indian Penal Code and Section 12 of POCSO Act. It is alleged that when the informant was going to ease out in the field, this petitioner assaulted with fist on her back and started snatching her shaul. The other co-accused Sushil Paswan abused and caught her hand.
It has been submitted that similarly situated co-accused Sushil Paswan has been allowed anticipatory bail in Cr.Misc.No.23128 of 2018 on 26.04.2018 by one of the
Patna High Court Cr.Misc. No.31667 of 2018 (3) dt.11-07-2018 coordinate bench of this court. The case of this petitioner stands on similar footing. He is in custody since 16.01.2018 having clean antecedent and so he deserves to be enlarged on bail. The learned A.P.P. for the State opposed the submission.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Arrah in connection with Tiar P.S.
