ANJANA MISHRA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 26.04.2017 in connection with a case registered for the offences punishable under Sections 395/397 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that he along with 20 unknown persons looted Rs. 13 thousand cash, ATM Card and PAN Card on the point of revolver. Learned counsel for the petitioner further submits that though the petitioner is not named in the FIR, the petitioner's name has been specifically taken as there is political rivalry between the informant and the present petitioner. Patna High Court Cr.Misc. No.48559 of 2017 (2) dt.17-10-2017 2/3 granted bail vide order dated 20.09.2017 passed in Cr. Misc. No. 42593 of 2017.
Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gaya, in connection with Belaganj P.S. Case No. 124/2017 with the following conditions:-
(1) One of the bailors will be their own relative, namely, father, mother, brother, sister and/or their wife.
(2) The petitioners shall not indulge themselves in any similar offence till conclusion of the trial.
(3) The petitioners shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, their bail bonds shall be liable to be cancelled by the learned court concerned.
(4) The petitioners shall co-operate with the investigation, if not already concluded, and make themselves available as and when so required and in case of failure, the State shall be at liberty to
