01-09-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Nawada (Town) P.S. Case No. 1244 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per prosecution case, this petitioner is alleged to have assaulted the informant by lathi, as a result of which, blood started oozing out from his head.

It is submitted on behalf of petitioner that petitioner is innocent and has falsely been implicated in this case. In fact, no such occurrence has taken place. It is further submitted that there is case and counter case and the case, vide Nawada (Town) P.S. Case No. 1229/2019, filed from the petitioner's side is on

Patna High Court CR. MISC. No.15089 of 2020(3) dt.01-09-2020 2/2 earlier point of time. The present case has been filed only to put pressure on petitioner's side. Petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, the anticipatory bail application is allowed.

In the event of arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada (Town) P.S. Case No. 1244 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
