The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506, 302, 379 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the F.I.R named accused persons including petitioners and 10-12 unknown surrounded the uncle of the informant namely Jagannath Yadav and co-accused Dukhi Yadav twisted the neck of Jagannath Yadav due to which, he
Patna High Court CR. MISC. No.16611 of 2022(3) dt.04-08-2022 2/3 died at the spot. When other family members of the deceased came to his rescue, they were assaulted by the accused persons including the petitioners.
It is submitted by learned counsel for the petitioners that specific accusation of twisting the neck of the deceased is against Dukhi Yadav who is not petitioner before this Court. There is general and omnibus allegation against the petitioners that they were present at the time of occurrence. There is no specific accusation against the petitioners that they assaulted any injured. The postmortem report also suggests that death was due to intracranial hemorrhage, concussion and shock. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)
Patna High Court CR. MISC. No.16611 of 2022(3) dt.04-08-2022 3/3 each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Keoti P.S. Case No. 192 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
