The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code and under Section 138 of the N.I. Act. The complainant alleged that he lent Rs. 1,55,000/- to the petitioner, but the petitioner did not return the money. The petitioner handed over cheques, but the same was dishonoured. It is submitted that the petitioner did not issue any cheque. The petitioner lost the cheque and accordingly, he informed the bank to not make any payment.

Learned counsel for the complainant, however, opposed the prayer for anticipatory bail and submitted that two other cases

Patna High Court Cr.Misc. No.28828 of 2014 (8) dt.26-11-2015 2/2 of similar nature are also pending against the petitioner. The petitioner is in the habit of taking money and issuing cheques. Having considered the facts aforesaid and the fact that the petitioner issued a cheque which was dishonoured and he has got two other cases of similar nature, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
