The petitioner is in custody since 15.05.2017 in connection with Ishipur (Barahat) P.S. Case No. 7 of 2017 for the offence registered under Sections 341, 323, 307, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the alleged incident is of 02.03.2017, the first information report has been lodged on 09.03.2017 i.e. after delay of seven days, for which, no plausible explanation has been offered by the informant. It is further submitted that in the first information report, it has been stated that the injured was treated at JLNMCH, Bhagalpur whereas the injured in his statement stated that he was treated at Siliguri. The said statement of the informant appears to be dubious and casts cloud on the prosecution story.
