The petitioner seeks bail in Pakaridayal P.S. Case No.17 of 2017 registered under Section 387 & 120 B of the Indian Penal Code.

As per the prosecution case, Rs. 30 lac was demanded from the informant as extortion by someone through his mobile introducing himself as Shiv Shankar Sharma, President of New Ranvir Sena and threatened with dire consequences in case of not coughing up the demand.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid Shiv Shankar Sharma. The petitioner is not named in the F.I.R. There is nothing in the case diary to indicate his complicity in the occurrence

Patna High Court Cr.Misc. No.45976 of 2017 (02) dt.19-09-2017 2 / 2 barring the confessional statement of co-accused which has no evidentiary value in the eye of law. Similarly situated co-accused Mritunjay Thakur has been granted bail by this Court in Cr. Misc. No.33963 of 2017. The petitioner has been languishing in custody since 09.05.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5thAdditional Chief Judicial Magistrate, East Champaran at Motihari in connection with Pakaridayal P.S.
