The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 353, 188, 393 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 14.9.2022 at 6:45 AM, while he was on patrolling with other police personnel and when he reached Maa Khadya Bhandar, Rajgir Road, he saw 75 accused were standing in front of his shop blocking the road, further when a tractor came loaded with minerals the accused persons began to loot the minerals loaded on the tractor and when the informant prevented them from indulging in the offence they abused and

Learned counsel for the petitioner submits that the petitioner have been falsely implicated in the present case, it is next submitted that the allegations are general and omnibus in nature, no specific overt act has been alleged against the petitioner, it is also submitted that petitioner is a senior citizen and there is no injury report on record.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Islampur P.S. Case No. 483 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
