JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,,148,341,323,307 and 427 of the Indian Penal Code and section 27 of the Arms Act.

The prosecution case is that the accused persons were forcibly ploughing the land of the informant. On protest being made, petitioner no. 3 Ganesh Choudhary assaulted Gautam Kumar with lathi. Petitioner nos. 1 and 2 assaulted Vikas Kumar with bamboo.

It is submitted by the learned counsel for the petitioners that in the background of bonafide land dispute the accusation has been levelled. It is further submitted that the injury of three injured

Patna High Court Cr.Misc. No.17463 of 2016 (2) dt.25-04-2016 2/2 have been found to be simple. There is counter version of the occurrence and six persons from the petitioners side received injury. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Runni Saidpur P.S. Case No.63 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
