The petitioner is facing accusations punishable under Sections 341, 323, 379, 504 and 506 of the Indian Penal Code vide Barhara (Raghubansh Nagar) P.S. Case No. 40 of 2016. The informant while riding the motorcycle was signaled by the petitioner to stop. When he stopped the motorcycle, two other accused persons along with the petitioner forcibly snatched Rs. 28,000/- from the pocket. The informant was thereafter allowed to go.
It is stated that the allegations are concocted. The time of the occurrence has not purposely been given. The learned Sessions Judge in the impugned order has wrongly recorded that it would constitute an offence under Section 392 IPC. The petitioner is a Ward Member.
Patna High Court Cr.Misc. No.17292 of 2016 (2) dt.03-05-2016 2/2 Learned APP opposed the prayer and submitted that in course of investigation, the witnesses have supported the allegation.
Consider the above, I am not persuaded to extend the privilege of anticipatory bail to the petitioner. Prayer is rejected.
