JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is in custody since 01.02.2020 and is a person of clean antecedents, seeks bail in connection with Sabour P. S. Case No. 373 of 2019 dated 26.12.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the records that a vehicle was attempted to be intercepted, when two persons came out of the vehicle and ran away. Later, 195 litres of liquor was recovered from the said vehicle.

The petitioner has been made accused, it has

There has not been any recovery from his conscious possession.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Additional Sessions Judge II cum Special Judge, (Excise Act), Bhagalpur in connection with Sabour P. S. Case No. 373 of 2019.
