The petitioner seeks bail in Chousa P.S. Case No. 47 of 2018 registered under Section 365/34 of the Indian Penal Code. Father of the petitioner, namely, Mahendra Yadav is said to have executed an agreement of sale in favour of the informant and given possession of the property to him. But despite taking consideration amount, he did not execute the sale deed in favour of the informant and on insistence made by him, they extended threatening of dire consequence to him. The son of the informant was kidnapped while he was asleep in his basa and informant suspected the name of the petitioner in the occurrence. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.31490 of 2018 (2) dt.24-05-2018 2/2 that the petitioner has no concern with the aforesaid occurrence. His father had never executed any agreement of sale in favour of the informant. He has been falsely implicated in the case by the informant due to land dispute by concealing his son in the house of his uncle (Mausa) from where the police has recovered the victim. He has no criminal antecedent. He has been languishing in custody since 06.03.2018. Father of the petitioner namely Mahendra Yadav has been enlarged on bail by a co-ordinate bench of this court vide order dated 10.05.2018 passed in Cr. Misc. No. 28201 of 2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Chousa P.S. Case No. 47 of 2018.
