Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. A stolen tempo was allegedly recovered from possession of the petitioner.
Submission is that due to dispute arising out of nonpayment of money advanced by the owner of the tempo, the tempo was taken away by one Sanwar Alam and the petitioner was driver of Sanwar Alam. Petitioner is in custody since 20.12.2019. Petitioner has got no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail, after completion of investigation, on furnishing bail bond of Rs. 20,000/- (Rupees

No.14824 of 2020(2) dt.03-03-2020 2/2 Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court-below where the case is pending in connection with Barsoi Police Station Case No. 288 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
