The petitioner No. 1 being husband of the daughter of the complainant and petitioner No. 2 being second wife of petitioner no. 1, are apprehending their arrest in a Complaint Case wherein cognizance has been taken under Section 498A of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

The basic accusation is of torture for nonfulfillment of dowry demands. Learned counsel for the petitioners submits that the husband of the daughter of the complainant filed Matrimonial Case No. 201/2014 with a prayer for divorce and thereafter the

Patna High Court Cr.Misc. No.17817 of 2016 (2) dt.25-04-2016 2/2 present complaint petition has been filed.

Considering the filing of matrimonial case at earlier point of time and accusation being omnibus and general against the entire in laws' family including the petitioners, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, in connection with Tr. No. 5737 of 2015 arising out of Complaint Case No. 3548 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
