This is an application for bail in connection with Imadpur P.S.Case No. 25 of 2017 registered for the offences punishable under Sections 307, 504/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of firing on Hira Devi, wife of informant, causing injury to her.

Submission of learned counsel for the petitioners is that no injury report was brought on the record and, as a matter of fact, Hira Devi did not sustain any injury and they are in custody since 28.6.2017 having no criminal antecedent.

Heard learned APP also, who has opposed the prayer for bail on the ground that there is allegation of firing against them.

No.46662 of 2017 (2) dt.21-09-2017 2/2 Having heard both sides and in view of submission made above, this application is disposed of with a direction to the court below to call for case diary and injury report and if Hira Devi has not sustained any fire arm injury, the court below will release the petitioners on bail to its own satisfaction.
