JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.
It is alleged that the petitioner hired Bolero vehicle of the informant and on the way co-accused Amit Kumar, Himanshu Ranjan and Sanny Kumar joined the petitioner, subsequently coaccused Suny Kumar caused firearm injury on the chest of the informant and escaped.
It is submitted by learned counsel for the petitioner that the petitioner lodged Nawada P.S. Case No. 575 of 2014 levelling accusation under Sections 341, 323, 384, 379 and 504/34 of the IPC and Section 27 of the Arms Act against the informant, hence as a retaliatory measure, the present case has been lodged.
Patna High Court Cr.Misc. No.22491 of 2015 (2) dt.07-07-2015 2/2 Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ghoshi P.S. Case No. 286 of 2014 pending in the court of learned SDJM, Jehanabad. Accordingly, the application is disposed of.
