JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Pirpainty P.S. Case No. 309 of 2015, disclosing offences under Sections 302/34 and 120B of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner has vehemently argued that there is no allegation in the First Information Report of any overt act against the petitioner nor any material has come to this effect, in course of investigation.

However, considering the fact that the petitioner is an accused in a case under Section 302 of the Indian Penal Code and

Patna High Court Cr.Misc. No.17752 of 2016 (3) dt.29-06-2016 2/2 his custodial interrogation may be required, I am not inclined to grant him privilege of anticipatory bail.

Accordingly, this application for anticipatory bail is, hereby, rejected.

The petitioner is directed to surrender before the court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
