The petitioner is in custody since 07.05.2016 in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has been roped in on the basis of mere suspicion. Till date, only five out of sixteen prosecution witnesses have been examined. The sessions Judge has reported that bailable warrant has already been issued against the rest unexamined witnesses. In view of the nature of allegations and that the trial Court might yet take some time in concluding the process of

No.39062 of 2017 (3) dt.21-09-2017 2/2 examination of witnesses, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, in connection with Kotwali P.S. Case No. 55/2014, subject to the condition that one of the bailors will be his own relative, namely, father, mother, brother, sister and/or his wife.
