The petitioner seeks regular bail in connection with Mithanpura P.S. Case No. 14 of 2018 for the offences punishable under Sections 25(1-b) (a) 26 of the Arms Act. The allegation is regarding recovery of one country made pistol and one live cartridge from possession of the petitioner.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and is languishing in custody since 22.01.2018. It is further submitted that though three other cases are pending against the petitioner herein, but the petitioner is on bail in the said cases. Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.30734 of 2018 (2) dt.22-05-2018 2/2 case, I direct for release of the petitioner on regular bail immediately upon completion of six months of his custody i.e. from 22.01.2018, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Muzaffarpur in connection with Mithanpura P.S. Case No. 14 of 2018 and also subject to other terms and conditions as may be deemed fit and proper by the learned trial court.
It is further directed that the petitioner would mark his presence before the Officer Incharge of the concerned Police Station at 10 A.M. on each and every Monday of the month and in the event of his failure on two consecutive occasions to mark his attendance, the present privilege of bail shall stand cancelled automatically.
